By visiting kneeawashau.world, creating a membership account, purchasing any product including the Essential Walker Membership, Guided City Walk Pass, or Premium Trail Kit Bundle, registering for a guided walk, or submitting information through our contact form, you confirm that you have read, understood, and agree to these Terms of Use, our Privacy Policy, Cookies Policy, and Return Policy. If you do not agree with any provision of these terms, you must discontinue use of the website and our services immediately.

2. About Kneeawashau

Kneeawashau is a walking club based in New York City, operating from 136 W 87th St, New York, NY 10024, United States. We provide guided urban walking experiences, membership programs, and curated walk gear products designed for city explorers. Our services are available to individuals aged 18 and older, with youth participation permitted under specific conditions outlined in our membership guidelines.

3. Website Use and Conduct

You agree to use kneeawashau.world only for lawful purposes and in a manner consistent with these Terms of Use. Prohibited activities include attempting to gain unauthorized access to any portion of the website or its systems, using automated tools to scrape content or data without prior written consent, transmitting malicious code or harmful content, impersonating another person or entity, posting false or misleading information in contact forms or membership applications, and interfering with the proper functioning of the website or the experience of other users.

All content on kneeawashau.world, including text, images, route descriptions, product information, and design elements, is the property of Kneeawashau or its licensors and is protected by United States copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without express written permission.

4. Membership Terms

Kneeawashau offers membership tiers including Explorer, Trailblazer, and Summit, as well as the Essential Walker Membership product available at $24.99 per month. Membership benefits, walk allocations, guest pass privileges, and discount levels are described on our club-membership.html and walk-gear.html pages and are incorporated into these Terms by reference.

Membership subscriptions renew automatically on a monthly basis unless cancelled prior to the next billing cycle. Members may pause membership for up to two months per year on Trailblazer and Summit tiers by contacting us at least seven days before the desired pause date. Membership fees are non-refundable for partial months except as described in our Return Policy. Members are responsible for maintaining accurate account information and notifying Kneeawashau of any changes to contact details or emergency contact information.

5. Product Purchases

Products offered by Kneeawashau include the Essential Walker Membership ($24.99/month), Guided City Walk Pass ($49.99 for five sessions valid 90 days), and Premium Trail Kit Bundle ($79.99). All prices are listed in United States dollars and are subject to change without prior notice. Published prices at the time of confirmed order apply to your purchase.

Orders are confirmed upon receipt of payment and order acknowledgment from Kneeawashau. We reserve the right to refuse or cancel any order due to product unavailability, pricing errors, suspected fraudulent activity, or other circumstances at our sole discretion. In the event of cancellation after payment, a full refund will be issued to the original payment method within ten business days.

6. Guided Walk Participation

Participation in guided urban walks organized by Kneeawashau is subject to additional conditions. Walk participants must arrive at the designated meeting point at least ten minutes before the scheduled departure time. Participants are responsible for their own physical readiness and must inform coordinators of any health conditions, mobility limitations, or accessibility needs prior to the walk.

Kneeawashau walk coordinators provide route guidance, safety oversight, and group management but do not assume liability for injuries resulting from participant negligence, pre-existing conditions, or failure to follow coordinator instructions. Walks may be rescheduled or cancelled due to severe weather, safety concerns, or insufficient registration, with participants notified as early as possible and offered rescheduling or credit toward future walks.

7. Payment Terms

All payments for Kneeawashau products and services must be made through approved payment methods displayed during checkout or communicated during the order process. You represent that you are authorized to use the payment method provided. Failed payments may result in suspension of membership benefits or cancellation of pending orders. Chargebacks initiated without first contacting us to resolve the issue may result in permanent account termination.

8. Intellectual Property

The Kneeawashau name, logo, trail route descriptions, digital route library content, product branding, website design, and all associated materials are the exclusive property of Kneeawashau. Unauthorized use of our trademarks, route content, or product descriptions for commercial purposes is strictly prohibited. Members receive a limited, non-transferable license to access digital route materials for personal, non-commercial use during their active membership period.

9. Disclaimer of Warranties

Kneeawashau.ddd and all services, products, and content are provided on an as-is and as-available basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. Walk gear products are covered by manufacturer warranties where applicable, as described in product documentation.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Kneeawashau and its officers, coordinators, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website, participation in guided walks, or purchase of products, including loss of profits, data, or goodwill. Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to Kneeawashau in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Kneeawashau and its affiliates from any claims, damages, losses, liabilities, and expenses arising from your violation of these Terms of Use, your participation in walks, misuse of membership benefits, or infringement of any third-party rights through your use of our services.

12. Governing Law and Disputes

These Terms of Use are governed by the laws of the State of New York, United States, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or your use of Kneeawashau services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in New York County, New York, under the rules of the American Arbitration Association, except where prohibited by applicable consumer protection laws.

13. Modifications to Terms

Kneeawashau reserves the right to modify these Terms of Use at any time. Changes become effective upon posting to kneeawashau.world with an updated revision date. Material changes affecting active memberships or product purchases will be communicated to affected members via email. Continued use of the website after changes constitutes acceptance of the modified terms.

14. Termination

We may suspend or terminate your access to kneeawashau.world and membership account at our discretion if you violate these Terms, engage in conduct harmful to other members or coordinators, or fail to pay applicable fees. Upon termination, your right to access membership benefits, digital route library, and unused walk passes ceases immediately, subject to any rights outlined in our Return Policy.
